Privacy Policy

How AmplaVia processes personal data when you use AmplaTV, its applications, dashboards and related services.

This Privacy Policy explains how AmplaVia Soluções Digitais LTDA, registered with the Brazilian National Registry of Legal Entities (CNPJ) under No. 59.200.682/0001-29, processes personal data when you use AmplaTV, its applications, dashboards and related services.

This policy should be read together with the AmplaTV Terms of Use (in Portuguese).

1. What AmplaTV is

AmplaTV is a cross-platform media player and media management software.

The application allows users to connect compatible external sources, including M3U playlists, credentials for services compatible with Xtream Codes and other sources supported by the application, in order to access and play content made available by those sources.

AmplaVia does not provide, sell, host, license, curate or distribute television channels, movies, series, events, audiovisual programming, M3U playlists or content subscriptions as part of the AmplaTV service.

The content accessible through the application comes from external sources configured, contracted or authorized by the user or by third parties chosen by the user.

AmplaVia does not exercise prior control over the catalog made available by these sources and does not presume that the existence of certain content in an external source means that its provider holds the respective rights of distribution, broadcasting, reproduction or making available.

The user is responsible for using AmplaTV exclusively with sources and content to which they have a legitimate right of access.

The use of AmplaTV does not grant the user any license, authorization or right over content belonging to third parties.

2. Data we may process

Depending on how AmplaTV is used, we may process:

  • Account data: name, email address, hashed password, access profile and preferences.
  • Authentication data: session tokens, device tokens, pairing codes and identifiers needed to keep devices connected.
  • Device data: platform, device name, model or technical information, application version and technical identifiers used for security and support.
  • Content and usage data: registered sources or servers, categories, favorites, playback history and progress, profiles, and language, subtitle, quality and autoplay preferences.
  • Plan, subscription and billing data: account plan (Free or Premium), usage of plan limits (devices, profiles and sources), use of the trial period, origin of the subscription (website, Roku, Google Play, Amazon or another store), status, due dates, renewals, cancellations, chargebacks and transaction, customer and invoice identifiers needed to confirm payments. AmplaVia does not store the full details of the card used for payment.
  • Website payment data: to issue the charge for Premium purchased through the website, the payer's name, email address and CPF or CNPJ (Brazilian individual or company taxpayer number) are sent to the payment processor (section 6.2). AmplaVia does not keep the full CPF or CNPJ number: it remains with the processor, and AmplaTV displays at most the last two digits so the person can check which document the charge is issued to.
  • Plan usage data: events such as attempting to exceed a Free plan limit, viewing the Premium offer, starting the trial, starting a purchase and subscribing, recorded together with the plan, platform, application version and the resource involved (device, profile or source). These events are used to measure and improve the product and are not used for third-party advertising.
  • Support and communication data: messages, requests and any other information you choose to provide to the team.
  • Technical data: IP address, date and time, route accessed, request status, performance information, errors and security-related logs.
  • Locally stored data: settings, session, local database, image cache, downloads and application preferences.
  • Roku TV data: on first pairing, the Roku application may send AmplaTV a technical device identifier, a fingerprint hash, the model, a friendly name and the Roku platform identification. These data are used to register, authenticate, limit and manage the device.
  • Roku account data: when signing in or creating an account on Roku TV, Roku itself may ask whether you want to share the email address (and, on sign-up, the name) of your Roku account with AmplaTV. These data are only sent if you choose to continue on that screen, and are used to fill in the form. The application also checks the Roku account's purchases to recognize an AmplaTV subscription made through Roku Pay.

We do not request sensitive personal data for the normal use of AmplaTV. We recommend that users do not send sensitive data through support requests, except when strictly necessary.

On Roku TV, the session and certain preferences are kept in the device's own local storage.

The application does not store the full catalog in the Roku's local storage. The necessary information is retrieved when the application needs to load playlists, profiles, catalog, program guide, favorites, progress or playback state.

The Roku may also store recent searches and temporary session or profile PIN tokens locally to avoid unnecessary re-pairing or re-entry.

3. How we use the data

We may use the data processed by AmplaTV to:

  • create and manage accounts, profiles and devices;
  • authenticate access and pair devices;
  • prevent fraud, abuse and unauthorized use of the service;
  • synchronize favorites, progress and preferences across devices;
  • load and organize sources configured by the user;
  • enrich the presentation of the sources registered by the user with third-party information, such as covers, images, synopses, movie and series information and other content-related metadata;
  • play media and provide features requested by the user;
  • process downloads requested by the user;
  • receive and process playback requests sent by another device linked to the same account, when the feature is available;
  • manage the Free and Premium plans, trial periods, subscriptions, renewals and cancellations;
  • enforce the limits of each plan and, when the account returns to the Free plan, temporarily block profiles and sources above the limit, without deleting them;
  • issue charges and invoices for Premium purchased through the website and recognize payments, chargebacks and disputes reported by the payment processor;
  • measure the use of the plans and of the Premium offers to improve the product;
  • confirm and reconcile payments and subscription status;
  • send necessary communications related to the account, security, authentication, subscription, billing, relevant changes to the service, customer service, privacy and contractual changes;
  • send promotional communications when permitted by applicable law and in accordance with the preferences made available to the user;
  • respond to support requests;
  • diagnose failures and improve the stability, performance and security of the service;
  • investigate violations of the Terms of Use or potential abuse;
  • receive and process communications related to third-party rights;
  • comply with legal or regulatory obligations or orders from competent authorities; and
  • exercise rights in administrative, judicial or arbitral proceedings.

AmplaVia does not use the content of the sources registered by users to assemble or curate its own audiovisual programming.

AmplaTV does not offer its own audiovisual catalog as part of the playback service.

4. Legal bases

Where the LGPD — Lei Geral de Proteção de Dados Pessoais (Brazilian General Data Protection Law, Law No. 13,709/2018) — applies, personal data may be processed, as the case may be, on the basis of:

  • the performance of a contract or of preliminary procedures related to the contract;
  • compliance with a legal or regulatory obligation;
  • the regular exercise of rights;
  • legitimate interest, subject to the applicable legal requirements; or
  • consent, where required.

Where processing depends on consent, the data subject may withdraw it under the terms of the applicable law, without affecting the lawfulness of processing carried out previously.

5. Third-party sign-in

If the user signs in with Google or another enabled identity provider, we may receive the data needed to authenticate the account, such as the identifier and email address provided by the respective provider.

The authentication provider may process data in accordance with its own terms and privacy policies.

AmplaTV does not receive the password the user uses with Google.

6. Data sharing

We may share personal data when necessary for the purposes described in this policy, including with:

  • hosting, database, network, storage, email, monitoring and security providers;
  • authentication providers chosen by the user;
  • app stores and platforms through which a subscription is purchased, including Roku (Roku Pay), Google Play, Amazon Appstore and Apple App Store, for processing and managing the respective subscriptions;
  • the website's payment processor, when Premium is purchased directly through AmplaVia's channels (section 6.2);
  • data and metadata providers used to enrich the presentation of information in the application, as described in this policy;
  • public authorities, when there is a legal obligation or a valid order;
  • professional advisors and service providers bound by confidentiality obligations; and
  • third parties involved in any corporate reorganization, merger, acquisition or transfer of assets, subject to the rights of data subjects and the applicable law.

When the subscription is purchased through an app store or third-party platform, the respective provider may process information related to the purchase, payment, subscription, renewal and cancellation in accordance with its own terms and privacy policies.

AmplaVia does not sell personal data.

AmplaVia does not share personal data with third parties for third-party behavioral advertising.

The content sources registered by the user may receive requests necessary for the operation of their own services, including requests to obtain the catalog, images, program guide and playback.

These sources are independent of AmplaVia and may have their own terms, privacy policies and data processing practices.

The user is responsible for evaluating the external services they decide to register and must not use sources they are not authorized to access.

6.1. TMDB data and metadata

AmplaTV uses data made available by The Movie Database (TMDB) to enrich the presentation of the sources registered by the user, and may obtain information such as titles, covers, images, synopses and other metadata related to movies and series.

To find matching information on TMDB, elements related to the content present in the source registered by the user may be used, such as title, content type, year or other identifiers needed for matching.

Data obtained from TMDB is used to improve the organization and presentation of information in AmplaTV and does not mean that TMDB provides, hosts, authorizes or is responsible for the audiovisual content played by the user.

The use of TMDB data and services is subject to the applicable terms and policies of that provider.

6.2. Payment for Premium through the website

When Premium is purchased through the website, the charge is issued and processed by Asaas Gestão Financeira Instituição de Pagamento S.A. ("Asaas"), which receives the payer's name, email address and CPF or CNPJ, as well as the amount and billing frequency of the subscription. Payment by Pix, card or boleto (Brazilian bank payment slip) is made on the Asaas invoice page, and card details are provided directly to Asaas.

AmplaVia receives from Asaas the customer, subscription and invoice identifiers, the payment method, the due dates and the status of each payment (pending, paid, overdue, refunded or disputed), in order to activate, maintain or terminate the account's Premium.

Asaas also processes these data in accordance with its own terms and privacy policy.

7. External sources and third-party content

AmplaTV works as media player and media management software and does not provide the user with the content available in the registered external sources.

Registering a source in AmplaTV does not mean that AmplaVia has reviewed, approved, licensed, authorized or validated the content made available by that source.

AmplaVia has no editorial control over the catalog made available by external sources registered by users.

The user must use only sources and content they are legally authorized to access.

It is prohibited to use AmplaTV to make available, sell, distribute or deliberately access content in violation of copyright, neighboring rights or other third-party rights.

AmplaVia may restrict, suspend or block a source, account, device or feature when it:

  • receives an order from a competent authority;
  • receives a sufficiently substantiated notice of a possible infringement of rights;
  • identifies sufficient evidence of a violation of the law or of the Terms of Use;
  • identifies abusive or fraudulent use of the service; or
  • identifies a risk to the security, stability or integrity of the platform.

8. Copyright and intellectual property

The purchase, subscription, installation or use of AmplaTV only grants the user the right to use the software in accordance with the Terms of Use and the applicable license.

No payment made to AmplaVia for AmplaTV constitutes payment for a subscription to channels, movies, series, events or other third-party content.

No payment made to AmplaVia grants a license or authorization to access, reproduce, broadcast, distribute or make available works belonging to third parties.

The user is responsible for obtaining from the respective rights holder, broadcaster, distributor, platform, provider or authorized supplier any licenses, subscriptions or authorizations needed to access a given piece of content.

AmplaVia does not claim ownership of third-party content accessed through external sources registered by the user.

8.1. Copyright infringement notices

Copyright holders, duly authorized representatives or other legitimate third parties may notify AmplaVia of possible unauthorized use of works at [email protected].

Whenever possible, the notice should contain sufficient information to allow the occurrence to be analyzed and identified, including:

  • identification of the complainant and contact details;
  • identification of the work or right allegedly infringed;
  • indication of the source, address, URL, server or other technical element that allows the occurrence to be located;
  • an objective description of the possible infringement; and
  • where applicable, proof that the complainant is the rights holder or is authorized to represent them.

AmplaVia may request additional information reasonably necessary to verify the legitimacy, accuracy and scope of the notice.

Upon receiving a sufficiently identified and substantiated notice, AmplaVia may take the technical and legal measures appropriate to the case, including restricting access, blocking a source or feature, suspending an account and preserving the records whose retention is permitted or required by law.

Submitting a notice does not imply automatic acknowledgment that an infringement has occurred.

Where appropriate and legally permitted, AmplaVia may allow the user or the party responsible for the source to provide clarifications regarding the notice.

8.2. Repeat infringement and abusive use

Accounts, devices or sources repeatedly associated with proven violations of the Terms of Use, the applicable law or third-party rights may be suspended or blocked.

AmplaVia may take reasonable measures to prevent the service's mechanisms from being used to circumvent previously applied restrictions.

9. International transfers

Some infrastructure and technical service providers may process personal data outside Brazil.

Where there is an international transfer of personal data subject to the LGPD, the applicable mechanisms and measures will be adopted to protect such data in accordance with current legislation.

10. Security

AmplaVia adopts technical and administrative measures designed to protect personal data and the AmplaTV infrastructure, including, as applicable:

  • protected transmission;
  • credential protection;
  • passwords stored using appropriate cryptographic mechanisms;
  • session tokens;
  • access controls;
  • device authentication; and
  • technical and security monitoring.

No system connected to the internet can offer an absolute guarantee of security.

The user is also responsible for protecting their password, pairing codes, devices and the credentials of registered external sources.

Tokens, passwords and other access credentials must not be shared with unauthorized third parties.

11. Retention and deletion

We keep personal data for the period necessary to:

  • fulfill the purposes described in this policy;
  • provide and maintain the service;
  • comply with legal or regulatory obligations;
  • prevent fraud and abuse;
  • resolve disputes; and
  • exercise or defend rights.

When there is no longer a basis for keeping the data, it may be deleted, anonymized or aggregated, as permitted by law.

Subscription, billing and payment records may be kept for the period required by tax, accounting and consumer protection legislation, even after Premium is canceled or the account is deleted.

The data subject may request the deletion of the account and of the associated personal data.

Certain records may be preserved when their retention is necessary for compliance with a legal or regulatory obligation, the regular exercise of rights, fraud prevention, security or another legally permitted case.

Data stored exclusively on the device, such as downloads, cache and the local database, may need to be removed directly by the user using the controls available in the application, deleting the respective files or uninstalling the application.

12. Data subject rights

Under the applicable law, the data subject may request, where applicable:

  • confirmation of the existence of processing;
  • access to the data;
  • correction of incomplete, inaccurate or outdated data;
  • anonymization, blocking or deletion of unnecessary or excessive data or data processed in breach of the law;
  • portability, where applicable and regulated;
  • information about data sharing;
  • information about the possibility of not giving consent and the consequences of refusal;
  • withdrawal of consent;
  • deletion of data processed on the basis of consent, except where retention is permitted by law; and
  • review of decisions made solely on the basis of automated processing, where applicable.

AmplaVia may request information reasonably necessary to confirm the requester's identity and protect the data against improper access or deletion.

The data subject may also file a complaint with the ANPD — Autoridade Nacional de Proteção de Dados (Brazilian National Data Protection Authority), subject to the applicable procedures.

13. Cookies and similar technologies

The website and dashboards related to AmplaTV may use cookies, local storage or similar technologies to:

  • maintain sessions;
  • store preferences;
  • protect accounts;
  • prevent fraud; and
  • enable the technical operation of the service.

Strictly necessary cookies and technologies may be used regardless of consent where permitted by law.

Optional cookies, when used and subject to consent, will be handled in accordance with the choices made available to the user.

The applications may also store information locally to maintain sessions, preferences, cache, database and downloads.

Storing a piece of information locally does not necessarily mean that it is sent to AmplaVia.

14. Children and adolescents

AmplaTV does not allow children to independently create a purchasing account intended for acquiring and managing the service.

The service may offer kids profiles, intended for use by children under the management and supervision of the account holder.

The account holder is responsible for creating, configuring and managing the kids profile and the control features provided by the application.

The existence of a kids profile does not mean that AmplaVia selects, rates or guarantees the age-appropriateness of content coming from external sources registered by the user.

The account holder must check whether the source used and the content it makes available are appropriate for the child or adolescent.

Where personal data of children or adolescents is processed, AmplaVia will observe their best interests and the other requirements set forth in the applicable law.

AmplaVia does not use children's data for behavioral advertising.

15. Casting to other devices

When using Chromecast, AirPlay, Roku or another casting feature made available in a given version of the application, AmplaTV may discover devices on the local network and transmit the information technically necessary to start or control playback.

On Roku TV, AmplaTV may act as a receiver of playback or handoff requests coming from another authorized device of the same account.

DLNA features will only be subject to the specific provisions of this policy when actually made available in a version of the application.

Device discovery may use local network mechanisms such as Bonjour, mDNS, NSD or equivalent protocols.

The list of devices found is used to show the user the available casting options and does not, in itself, constitute a contact list or identification of individuals.

The user should only use casting features on networks and devices under their control or when authorized to use them.

16. Changes to this policy

This Privacy Policy may be updated to reflect changes in:

  • the operation of AmplaTV;
  • the features made available;
  • data processing practices;
  • security requirements; or
  • applicable laws and regulations.

The current version will be made available on AmplaTV's official channels and will indicate its update date.

When a change is relevant to users' rights or to the way their personal data is processed, AmplaVia may use reasonable means to communicate the update.
