These Terms of Use ("Terms") govern the use of AmplaTV, software made available by AmplaVia Soluções Digitais LTDA, registered with the Brazilian National Registry of Legal Entities (CNPJ) under No. 59.200.682/0001-29 ("AmplaVia", "we").
By creating an account, purchasing a plan or using AmplaTV, the user declares that they have read and agreed to these Terms and to the AmplaTV Privacy Policy.
AmplaTV is intended for persons 18 years of age or older. Children and adolescents may use profiles created and managed by the adult responsible for the account, in accordance with the features made available by the service.
1. What AmplaTV is
AmplaTV is cross-platform media player and media management software.
The application allows the user to connect compatible external sources, including M3U playlists, credentials for services compatible with Xtream Codes and other sources supported by the application.
AmplaTV is not a television, IPTV, content streaming or channel distribution service.
AmplaVia does not provide, sell, host, license, curate or distribute, as part of AmplaTV:
- television channels;
- movies;
- series;
- events;
- live broadcasts;
- M3U playlists;
- Xtream Codes servers or credentials;
- IPTV subscriptions; or
- any other audiovisual catalog belonging to third parties.
The content played by AmplaTV comes exclusively from the external sources registered by the user.
AmplaVia does not provide predefined sources, does not maintain a public directory of sources or providers, and does not select or recommend content providers as part of the AmplaTV service.
2. Independence between AmplaTV and content providers
AmplaTV and the content services contracted by the user are independent services.
Purchasing an AmplaTV plan:
- does not include an IPTV subscription;
- does not include channels, movies or series;
- does not grant access to any content provider;
- does not guarantee that a given external source will continue to work; and
- does not replace any subscription, license or authorization required by the content supplier.
Likewise, contracting a content provider does not mean that such provider is controlled, operated or endorsed by AmplaVia.
The user is responsible for contracting and maintaining, at their own expense and risk, the external services they decide to use.
3. How external sources work
External sources are registered exclusively by the user.
Audiovisual content is obtained directly from the source configured by the user to the device on which AmplaTV is running.
AmplaVia does not store on its infrastructure the audiovisual content played by the user.
AmplaTV also does not transcode audiovisual content on AmplaVia's servers.
When the user requests a download permitted by the application, the file will be obtained from the respective external source and stored on the user's device, subject to the technical limitations of the platform.
AmplaVia may store data necessary for the operation of the account, including favorites, playback progress and settings, as described in the Privacy Policy.
4. Responsibility for sources and content
The user is responsible for the sources they register in AmplaTV and must use only services and content to which they have a legitimate right of access.
The user is responsible for verifying whether the chosen provider holds the authorizations necessary to make the offered content available.
The technical compatibility of a source with AmplaTV does not mean that AmplaVia has:
- reviewed its content;
- authorized its use;
- verified its legal status;
- validated its supplier;
- established a partnership with its operator; or
- confirmed that the supplier holds rights over the works made available.
AmplaVia has no editorial control over the catalog of the external sources registered by users.
5. Copyright
The user undertakes to respect copyright, neighboring rights, trademarks, licenses and other applicable intellectual property rights.
It is prohibited to deliberately use AmplaTV to make available, sell, distribute, share or access content in violation of third-party rights.
Purchasing an AmplaTV plan grants only a license to use the software under the terms of this document.
No payment made to AmplaVia constitutes payment for channels, movies, series, events or any other content made available by third parties.
No payment made to AmplaVia grants a license or authorization over works belonging to third parties.
The authorizations necessary to access a given piece of content must be obtained directly from the respective rights holder, broadcaster, distributor, platform or authorized supplier.
6. Reports of rights infringement
Rights holders, authorized representatives or legitimate third parties may report a possible copyright infringement through [email protected].
Whenever possible, the report should contain:
- identification and contact details of the complainant;
- identification of the work or right involved;
- an objective description of the possible infringement;
- sufficient information to identify the source or occurrence; and
- where applicable, proof of ownership or representation of the right claimed.
AmplaVia may request additional information reasonably necessary to analyze the report.
Where there is sufficient evidence, AmplaVia may, according to the nature and seriousness of the case:
- remove the source from the account;
- restrict related features;
- temporarily suspend the account;
- terminate the account in serious or repeated cases; and
- take other measures required by law or by a competent authority.
Submitting a report does not constitute automatic acknowledgment that an infringement has occurred.
Where legally appropriate, the affected user may provide clarifications or dispute the report.
AmplaVia may establish a specific email address for intellectual property communications in the future.
7. Repeat infringement
Repeated use of AmplaTV in proven violation of third-party rights may result in the suspension or termination of the account.
The analysis may take into account, among other factors:
- the nature of the occurrence;
- recurrence;
- the number of occurrences;
- the seriousness of the conduct;
- the existence of evidence of deliberate use;
- the response provided by the user; and
- applicable legal or administrative determinations.
AmplaVia may take reasonable measures to prevent suspended users from using technical mechanisms to circumvent legitimate restrictions previously applied.
8. Registration and account
Creating an AmplaTV account is permitted only to persons 18 years of age or older.
The user must provide true, up-to-date and sufficient information for creating and maintaining the account.
The user is responsible for:
- keeping their credentials protected;
- preventing unauthorized access to the account;
- keeping their registration information up to date;
- protecting authenticated devices;
- reporting suspicious access; and
- answering for the activities carried out using their credentials, except in legally applicable cases.
The user must not provide their password, tokens, pairing codes or other credentials to unauthorized third parties.
9. Profiles and family use
The account holder may create profiles intended for members of their household, according to the features and limitations available in the purchased plan.
On the Free plan, the account has one profile, which can be configured to block adult content. On the Premium plan, the account can have up to six profiles, including kids profiles.
Family sharing is intended for private use by people in the same household.
It is prohibited to:
- sell access to the account;
- rent out the account;
- share credentials commercially;
- make access indiscriminately available to third parties; or
- use mechanisms intended to circumvent security controls.
Kids profiles must be created and managed by the adult responsible for the account.
AmplaTV may provide mechanisms such as a PIN to protect adult profiles and to control exiting kids profiles.
Parental controls are auxiliary tools and do not replace the supervision of the responsible adult.
10. Devices and simultaneous playback
On the Free plan, the AmplaTV account can be connected to one device. On the Premium plan, to up to six devices.
On the Free plan, the user can change the connected device once every 30 (thirty) days. Reconnecting the same device does not count as a change, and removing a device from the account is always permitted.
These limits belong to the AmplaTV plan and do not represent a limitation imposed by the content provider. Apart from the plan limits, AmplaVia does not, as a general rule, set its own limit on simultaneous screens for playing content coming from external sources.
However, the content provider used by the user may set its own limits on devices, connections or simultaneous playback.
These limitations belong to the external service and are not determined by AmplaVia.
AmplaVia may set reasonable technical limits related to account security, fraud prevention, infrastructure abuse or the operation of certain AmplaTV features, provided that such limits are not presented as limitations imposed on the provider's content.
11. Software license
For as long as these Terms are complied with, AmplaVia grants the user a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to use AmplaTV for personal and non-commercial purposes.
The license does not transfer to the user ownership of the software, trademark, source code, interface, graphic elements or other assets belonging to AmplaVia or its licensors.
Except where expressly permitted by applicable law, it is prohibited to:
- copy or redistribute the application without authorization;
- modify the software;
- reverse engineer it;
- decompile or disassemble the application;
- remove protection mechanisms;
- circumvent licensing mechanisms;
- develop or use cracks;
- tamper with authentication mechanisms; or
- commercially exploit the software without authorization.
12. Prohibited use
The user may not use AmplaTV to:
- commit unlawful acts;
- infringe copyright or other third-party rights;
- deliberately register sources they know to be used unlawfully;
- sell or redistribute access to AmplaTV without authorization;
- sell access to third parties using the AmplaTV identity or brand in an unauthorized manner;
- claim that content or an IPTV subscription is provided by AmplaVia when this is not true;
- share accounts commercially;
- circumvent legitimate technical limitations;
- bypass authentication or licensing mechanisms;
- obtain tokens, credentials or information belonging to other users;
- access areas or APIs without authorization;
- perform scraping or abusive automation;
- exploit vulnerabilities;
- interfere with the operation of the infrastructure;
- introduce malicious code;
- carry out denial-of-service attacks; or
- use resources in a manner capable of impairing the availability or security of the service.
Carrying out security tests on AmplaVia's infrastructure requires prior and express authorization.
13. Plans
AmplaTV adopts a freemium model, with two plans: Free and Premium.
The Free plan, at no charge, includes:
- one connected device;
- one profile;
- one content source (one M3U playlist or one Xtream Codes server); and
- the complete player, including search, catalog, program guide, favorites, playback progress and adult content control.
The Premium plan, which is paid, includes the same features with higher limits:
- up to six connected devices;
- up to six profiles; and
- up to ten content sources.
Premium does not limit image quality, platforms, program guide, search or parental controls in relation to the Free plan: it only increases the number of devices, profiles and sources.
The price and billing frequency of Premium are those presented at the time of purchase. When purchased through an app store or third-party platform, the price and billing frequency presented by the respective store at the time of purchase apply.
When purchased through the website, Premium costs R$ 9.90 (nine reais and ninety centavos) per month. When purchased through an app store or third-party platform, the price and billing frequency presented by the respective store at the time of purchase apply (for example, on Roku, the subscription is quarterly, through Roku Pay).
The Free plan does not automatically convert into a paid subscription. The current limits and prices are presented to the user in the application, in the account dashboard and before purchase.
13.1. Return to the Free plan
When Premium ends (cancellation, non-payment, chargeback or end of the trial), the account returns to the Free plan without profiles, sources, devices, favorites or progress being deleted.
Whatever exceeds the Free plan limits remains blocked until the account is back within them or back on Premium: the main profile remains available and the other profiles are blocked from watching; the source chosen by the user (or, if none is chosen, the oldest one) remains available and the others are blocked. Blocked items can be edited or removed at any time, and the user can change which source remains enabled.
14. Trial period
AmplaVia may offer a free trial of Premium for 7 (seven) days, once per account, usually when the user tries to exceed a Free plan limit.
This trial does not require a payment method and does not generate any charge. At the end, if the user has not purchased Premium, the account automatically returns to the Free plan, under the terms of item 13.1.
App stores and third-party platforms may offer their own trial periods for purchases made through them. In such cases, the trial conditions, including any conversion into a paid subscription, will be presented by the store before purchase.
The promotional trial period is independent of the rights guaranteed to the consumer by applicable law.
AmplaVia may establish reasonable eligibility criteria intended to prevent repeated or abusive use of promotional periods.
15. Payments
Premium may be purchased through:
- the official AmplaTV website, in the account dashboard (tv.amplavia.com.br/premium);
- the Roku platform, through Roku Pay;
- Google Play;
- the Amazon Appstore;
- the Apple App Store, when available; or
- other channels officially made available by AmplaVia.
Through the website, payment is processed by Asaas Gestão Financeira Instituição de Pagamento S.A., by Pix (Brazilian instant payment system), credit card or boleto (Brazilian bank payment slip). To issue the charge, the processor requests the name, email address and CPF or CNPJ (Brazilian individual or company taxpayer number) of the payer.
AmplaVia does not store the full card details or the full CPF or CNPJ number provided to the payment processor.
When the purchase is made through a third-party store or platform, certain billing, renewal, cancellation and refund conditions may also be governed by the rules of the respective platform, without prejudice to the rights guaranteed by Brazilian law.
The applicable prices and conditions will be presented before the purchase is confirmed.
16. Renewal
Premium purchased through the website is monthly and renews every month until canceled:
- credit card: the charge is made automatically every month;
- Pix or boleto: a new invoice is sent by email every month, to be paid by the due date.
Each monthly payment made keeps Premium active until the next due date, with a grace period of up to 3 (three) days for payment of the next invoice. Without such payment, the account returns to the Free plan, under the terms of item 13.1, until the outstanding invoice is paid.
Purchases made through third-party stores or platforms follow the billing frequency and automatic renewal stated by the respective store.
17. Cancellation
The user may cancel the subscription at any time.
For Premium purchased through the website, cancellation is done in the account dashboard, at tv.amplavia.com.br/premium, using the "Cancel renewal" option, or through the contact email. Cancellation stops future charges, and Premium continues until the end of the period already paid; after that, the account returns to the Free plan, under the terms of item 13.1.
When the subscription was purchased through Roku, Google Play, Amazon, Apple or another platform, cancellation must be done on the respective platform (on Roku, for example, at my.roku.com or in the device settings).
Deleting the application or the content playlist does not cancel the subscription.
18. Refunds and consumer rights
For purchases made through the website, the user may withdraw within 7 (seven) days from the date of purchase, with a refund of the amount paid, pursuant to Article 49 of the Código de Defesa do Consumidor (Brazilian Consumer Protection Code), by making a request through the contact email.
Outside of this case, refunds will be made in the cases provided for by applicable law and, when the purchase was made through a third-party platform, in accordance with that platform's rules, without prejudice to the rights legally guaranteed to the consumer.
Payments that are charged back or disputed end the Premium related to them, and the account returns to the Free plan, under the terms of item 13.1.
Nothing in these Terms is intended to exclude rights that cannot be validly excluded or limited under Brazilian law.
19. Price changes
AmplaVia may change the prices of the plans.
Changes applicable to recurring subscriptions will be communicated in advance when required by law or by the rules of the platform through which the purchase was made.
Where applicable, the new price will take effect in subsequent billing cycles, respecting consumer rights and the conditions presented at the time of purchase.
20. Financial independence from the external source
The AmplaTV subscription and any subscription the user maintains with a content provider are independent relationships.
The unavailability, cancellation, blocking or termination of an external source does not automatically cancel the AmplaTV subscription.
Likewise, canceling AmplaTV does not terminate contracts entered into directly between the user and third parties.
The user must manage these contracts separately.
21. Availability of external sources
AmplaVia does not control and does not guarantee:
- the availability of external sources;
- the continuity of third-party services;
- the size or composition of the catalog;
- the channels available;
- image or audio quality;
- resolution;
- stability;
- buffering;
- latency;
- programming;
- subtitles provided by the source;
- the availability of the external EPG (electronic program guide); or
- the permanence of any given URL, API or protocol used by third parties.
Changes made by the source's supplier may cause temporary or permanent incompatibilities.
AmplaVia may modify or discontinue support for protocols, formats or technologies when necessary for technical, security, compatibility, maintenance or product evolution reasons.
22. Features and platforms
Depending on the platform, plan, application version and technical characteristics of the device, AmplaTV may make available features such as:
- content playback;
- profiles;
- kids profiles;
- parental controls;
- favorites;
- playback history and progress;
- synchronization of progress across devices;
- EPG;
- downloads;
- Picture-in-Picture;
- casting to compatible devices; and
- continuing playback on another device.
Not all features will necessarily be available on all platforms, operating systems or devices.
AmplaTV may be made available for Roku, Android, Android TV, Amazon Fire TV/Fire Stick, iOS, macOS, Windows, Linux and Web, as well as other platforms that may come to be officially supported by AmplaVia.
The updated list of supported platforms, versions and technical requirements can be found on AmplaTV's official channels.
The availability of the application for a given platform may also depend on the rules, technical requirements, approval processes and availability of the respective stores or manufacturers.
AmplaVia may add, change or discontinue support for certain platforms, operating system versions or devices when necessary for technical, security, compatibility, maintenance or product evolution reasons, subject to the rights legally applicable to users.
23. Changes to the service
AmplaVia may update the application, fix errors, modify interfaces, introduce features, change technical requirements or discontinue features.
Relevant changes that substantially affect a purchased plan will be handled in accordance with applicable law.
Older versions of the application may no longer be supported when necessary for the security, compatibility or maintenance of the platform.
24. Maintenance and unavailability
AmplaVia will use reasonable efforts to keep the services under its responsibility available and secure.
However, interruptions may occur as a result of:
- maintenance;
- updates;
- infrastructure failures;
- telecommunications problems;
- attacks;
- third-party events;
- acts of God or force majeure; or
- circumstances technically beyond AmplaVia's reasonable control.
No provision of this section limits rights or liabilities that cannot be excluded under applicable law.
25. Suspension and termination
AmplaVia may restrict, suspend or terminate accounts when there is sufficient evidence indicating:
- fraud;
- abuse;
- violation of these Terms;
- repeated violation of third-party rights;
- commercial account sharing;
- unauthorized resale;
- attempted intrusion;
- exploitation of vulnerabilities;
- unauthorized reverse engineering;
- tampering with the application;
- attempts to circumvent security mechanisms;
- risk to the infrastructure; or
- an order from a competent authority.
Whenever compatible with the nature and seriousness of the situation, less restrictive measures may be considered before definitive termination.
Immediate measures may be taken when necessary to protect users, third parties or the infrastructure.
26. Partners and providers
AmplaVia may enter into specific commercial agreements with third parties for the distribution or licensing of AmplaTV.
No third party may present itself as a partner, reseller or authorized representative of AmplaTV without a valid agreement with AmplaVia.
When a content provider wishes to offer AmplaTV together with its own service, this will depend on a specific agreement.
Entering into such an agreement does not transfer to AmplaVia editorial responsibility for, or ownership of, the partner's content.
The partner will be responsible for holding and maintaining the licenses, authorizations and other rights necessary for the content it provides.
AmplaVia may require reasonable documentation demonstrating the lawfulness of the content offered by the partner.
Authorization to distribute AmplaTV licenses does not authorize the partner to:
- claim that its content belongs to AmplaVia;
- use the AmplaTV brand in a manner different from that authorized;
- advertise its service as "official AmplaTV IPTV";
- attribute to AmplaVia responsibility for its catalog; or
- use the commercial relationship to mislead consumers about who provides the content.
The additional responsibilities of these partners must be governed by a separate agreement.
27. AmplaTV intellectual property
The AmplaTV software, its brand, visual identity, interfaces, documentation, graphic elements and other assets belonging to AmplaVia or its respective licensors are protected by applicable law.
These Terms do not transfer to the user any ownership rights over these assets.
Trademarks, works and content belonging to third parties remain the property of their respective holders.
28. Privacy
The processing of personal data related to AmplaTV is governed by the AmplaTV Privacy Policy, which forms part of these Terms to the extent applicable.
The Privacy Policy sets out, among other aspects:
- which categories of data may be processed;
- the purposes of processing;
- data sharing;
- retention;
- security;
- data subject rights; and
- contact channels.
29. Communications
AmplaVia may send communications necessary for the performance of the service, including messages related to:
- security;
- authentication;
- relevant changes to the service;
- subscription and billing;
- contractual changes;
- customer service;
- privacy; and
- account-related matters.
Promotional communications will be handled in accordance with applicable law and the preferences made available to the user.
30. Changes to these Terms
These Terms may be updated to reflect changes:
- in the service;
- in the features;
- in the plans;
- in the technologies used;
- in the requirements of distribution platforms;
- in the law; or
- in AmplaVia's business practices.
Relevant changes will be communicated by reasonable means when required by applicable law.
The current version will remain available on the official channels.
31. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil.
The rights guaranteed to consumers by Brazilian law apply in full whenever a consumer relationship is established.
No provision of these Terms shall be construed as a waiver of any right that the law establishes as non-waivable.
32. Jurisdiction
Without prejudice to the consumer's right to use the forum guaranteed to them by applicable law, the courts of the judicial district (comarca) of Maringá, State of Paraná, are chosen to resolve disputes related to these Terms, where such choice of forum is legally valid.
33. General provisions
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions will remain valid to the fullest extent permitted by law.
Any tolerance by AmplaVia regarding non-compliance with a given obligation will not constitute a waiver of the right to require its performance at a later time.
These Terms, together with the Privacy Policy and the specific conditions presented at the time of purchase, constitute the documents applicable to the use of AmplaTV, without prejudice to the conditions imposed by app stores where applicable.
